Terms of service

Last updated 4 September 2026

These terms are a binding contract between you and Tunnex Pty Ltd as trustee for the Tunnex Family Trust, ABN 64 878 795 346 (GST-registered), trading as Kinl, the operator of the kinl app and kinl.me ("kinl", "we", "us"). Our registered office is in Moonee Ponds VIC 3039, Australia and our postal address is PO Box 1037, Moonee Ponds VIC 3039, Australia. By creating an account, accessing or using kinl you accept these terms in full. If you do not accept them, do not use kinl.

1. Eligibility and your account

You must be at least 18 years old to use kinl, and at least the minimum digital consent age in your country where that age is higher. Everyone completes an age check at signup. You must not use kinl if you have previously been removed for a breach of these terms, or if any law prohibits us from providing the service to you.

You are responsible for everything that happens through your account, for keeping your credentials secure, and for the accuracy of the information you give us. Accounts are personal to you; you must not sell, rent, transfer or share an account, username or QR identity without our written consent.

2. The service is provided as it is

kinl is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted operation, or that the service will be free of errors, bugs, viruses or data loss.

We may add, change, suspend, limit or discontinue any feature, including posts, stories, keeps, maps, translation, assist, sounds, calls, boosts and subscriptions, at any time and without liability to you.

3. Temporary content and no guarantee of retention

kinl is built around temporary content. Posts expire by default after seven days, stories after twenty-four hours, and other content may expire, be archived, be purged on a retention schedule, or be removed at any time.

Keeps, saves, downloads and archives are conveniences, not a backup service. We do not guarantee that any content, message, media, keep or record will remain available, recoverable or exportable. You are solely responsible for keeping your own copies of anything you value.

4. Your content and the licence you give us

You keep ownership of the content you create. By posting, sending, uploading or otherwise making content available on kinl, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to host, store, cache, reproduce, adapt, translate, caption, resize, transcode, publish, publicly display and distribute that content for the purposes of operating, securing, improving and promoting the service.

This licence ends a reasonable period after you delete the content or your account, except where the content has been shared with others who have not deleted it, where a copy is retained in backups, or where we must retain it to comply with the law, resolve disputes, or enforce our terms.

You represent and warrant that you own or have all rights, consents and permissions needed for your content, including the rights of any person appearing in it and any music, audio, imagery or trade mark used in it, and that your content does not infringe any third-party right or law.

5. Acceptable use

You must comply with the Community guidelines and Acceptable use policy, which form part of these terms. In short, you must not use kinl to break the law, harm, harass, deceive, defraud, impersonate, stalk, spam, scrape, reverse engineer, circumvent security, overload our systems, or exploit the service commercially outside the paid features we offer.

6. Other people, places, events and links

kinl shows content created by other members and information about places, events, offers and businesses drawn from members, partners and public web sources. We do not verify, endorse or take responsibility for any of it.

Any interaction, meeting, transaction, arrangement or relationship you enter into with another member, business, place or event organiser is entirely at your own risk and is solely between you and them. We are not a party to it, we do not screen members, and we make no representation about anyone's identity, character, safety, conduct or suitability. You are responsible for exercising your own judgment about meeting people and going places.

7. Assist, recommendations and automated output

Assist, recommendations, translations, captions, mapkins, area vibes and other automated features are generated by machine learning systems. Their output may be inaccurate, incomplete, out of date, offensive or misleading, and must not be relied on as professional, legal, medical, financial, travel or safety advice. Always verify anything that matters before acting on it.

8. Location and maps

Location features are optional and are approximate by design. We deliberately reduce precision, but no location system is perfect. You accept that sharing approximate location, presence, mapkins or activity carries inherent risk, and you are responsible for choosing your visibility settings and for what you disclose in your content.

9. Paid features, billing and refunds

Paid features include kinl+ subscriptions, the Kinl Biz+ business subscription, post extensions, boosts, ads and physical stickers. Prices are shown before purchase in Australian dollars and include applicable taxes where indicated. Payments are processed by third-party providers; we do not store full card details.

Kinl Biz+ is a subscription for business accounts at A$149 per month. It unlocks the AI Receptionist. Every other business feature — the booking calendar and booking system, the business dashboard, voicemail and missed-call log, lead capture, the calendar API, posts that never expire, the dashboard assistant and priority placement when creators browse campaigns — is free on every business account and is not conditional on a subscription.

Subscriptions renew automatically at the then-current price until cancelled. Cancel at any time before the next renewal to avoid the next charge; cancellation takes effect at the end of the current billing period and unused time is not refunded except where the law requires it.

Digital purchases, including boosts and extensions, are consumed immediately and are not refundable once delivery has begun, except where required by the Australian Consumer Law or other non-excludable law. Delivery estimates for physical goods are estimates only.

Purchases made through an app store are also subject to that store's terms and refund rules.

We do not guarantee any level of reach, impressions, clicks, leads, conversions, followers or business outcome from boosts, ads or promotion. Estimates shown in the app are modelled projections, not promises.

10. Booking payments between customers and businesses

Kinl lets a customer pay a business for a one-to-one service they have booked through Kinl — a deposit, the full price, or a card saved for later, as that business has chosen for the service. Kinl only facilitates that payment. The service itself is provided by the business, not by Kinl; Kinl is not a party to the booking, does not supervise the service, and is not responsible for its quality, timing or outcome. Any dispute about the service is between you and the business, though you can report a business to us at any time. Group classes and other one-to-many sessions are booked on Kinl but are not paid through Kinl.

Kinl's commission. When a customer pays at booking, Kinl deducts a commission of 5% of the amount paid before the balance is credited to the business. When a business cashes out, Kinl deducts a further 5% of the amount being cashed out. Stripe, our payment processor, also charges fees for processing payments and for paying money out to a bank account, including a per-payout fee and a monthly active-account fee. Those Stripe fees are deducted from the business's side alongside Kinl's commission — Kinl does not absorb them — and the exact line items are shown to the business before every cash-out is confirmed.

Cash-out. A business can cash out its balance to a bank account through Stripe Connect once payouts are set up. The minimum cash-out is A$50. Money received from a customer is held for seven days before it becomes eligible to cash out, so that refunds under a cancellation policy can be settled first. Refunds owed under a business's cancellation policy come out of the business's balance.

Cancellations and refunds. Each business sets its own cancellation policy. Kinl shows that policy in full before a customer pays or saves a card, freezes it onto the booking so it cannot change afterwards, and applies it when a booking is cancelled. If a business cancels, anything the customer paid upfront is refunded in full. Not turning up is treated as a late cancellation under the business's policy.

11. Card on file

Where a service does not collect its full price at booking — because the business takes a deposit only, or takes nothing upfront — the customer's card is saved securely by Stripe at booking time and no charge is made at that moment. By booking such a service the customer authorises the business to charge that saved card later, up to the total price of the service shown at booking and never more than that, for either a no-show or late-cancellation fee under the business's stated cancellation policy, or the remaining balance of the service.

Every charge to a saved card is made deliberately by the business, one at a time, for an amount the business enters. Kinl never charges a saved card automatically, and Kinl enforces the price cap on its own systems so that the total charged to a booking — the amount taken upfront plus every later charge, less any refund — can never exceed the price the customer agreed to. The customer is notified each time their saved card is charged, with the amount and the reason.

This authorisation is disclosed to the customer in the booking screen at the time they book, before any card is saved, and must be accepted there; it does not rely on these terms alone. A customer who does not agree should not complete the booking. Kinl does not store full card details; the card is held by Stripe.

12. Suspension and termination

We may suspend, restrict, shadow-limit, remove content from, or permanently terminate any account at any time, with or without notice, where we reasonably believe there has been a breach of these terms or the law, a risk to other members or to kinl, or where we are required to do so.

You may delete your account at any time from Settings. Deletion is permanent and removes access to content, keeps, purchases and subscription benefits, subject to any legal retention obligation.

13. Limitation of liability

To the maximum extent permitted by law, we, our officers, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, opportunity, data, content or anticipated savings, however caused and on any theory of liability, arising out of or relating to your use of kinl.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to kinl is limited to the greater of one hundred Australian dollars or the total amount you paid us in the twelve months immediately before the event giving rise to the claim.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where liability can be limited but not excluded, our liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied.

14. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, liability, penalty, cost or expense (including reasonable legal fees) arising from your content, your use of kinl, your breach of these terms or of any law, or your interactions with other members or third parties.

15. Changes to these terms

We may update these terms. Where changes are material we will give reasonable notice in the app or by email. Continuing to use kinl after the effective date means you accept the updated terms.

16. Governing law and disputes

These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place. Before starting proceedings, you agree to contact us through kinl.me/contact (Help & support → Contact kinl in the app), or hello@kinl.me and attempt to resolve the dispute in good faith for at least thirty days.

17. General

If any part of these terms is found unenforceable, the rest continues in force. Our failure to enforce a right is not a waiver of it. You may not assign these terms; we may assign them as part of a reorganisation or sale of the business. These terms, together with the policies referenced in them, are the entire agreement between us.
